SVV BIDDER
TERMS OF SALE
The sale takes place at public auction. The sale is made expressly in cash.
The purchasers will pay by lot, in addition to the auctions:
24% T.T.C. for voluntary sales
Payment in cash is allowed up to 1,000 euros, including fees and taxes. Possibility of payment by credit card.
In the case of payment by uncertified check or in the absence of a bank commitment letter, the delivery of the lots may be deferred until receipt. The winning bidder will be the highest bidder and the last bidder. In the event of a dispute at the time of the invitation to tender, that is to say if two or more bidders have simultaneously carried out an auction, either aloud or by a sign, and request in time that lot, after the award has been made, the said lot will be immediately put back into the invitation to tender and all the public present will be allowed to bid again. Pre-exposure will allow buyers to see the status of items for sale, no claims will be allowed once the auction is issued. The transfer of ownership takes place immediately upon "award", as a result the successful tenderer becomes responsible for his lot after award.
Purchase orders by telephone are a service that the voluntary sales company HONFLEUR-ENCHERES SVV provides to buyers.
Honfleur-Encheres SVV will be able to accept free of charge the purchase orders sent to it 24 hours before the start of the sale in writing and accompanied by an R.I.B.
The successful tenderer shall be responsible for removal and transport.
The auction house does not ship the batches. It is up to the purchaser to take the necessary steps on their own to remove the lots.
The successful tenderers will be required, after payment, to take delivery of their lots as soon as possible. The storage of these is at the cost, risk and peril of the successful tenderers.
After one month of storage, a fee of 5€ per day will be due by the successful tenderers, if the lots are not yet in the auction room.
The sales company shall not be liable for incidents attributable to the mode of communication. Non-resident customers in France will only be able to take delivery of their purchases after a bank settlement by SWIFT. In the case of export, the purchaser will be reimbursed VAT on fees, on presentation of an export note issued by the customs, within one month. No claims will be allowed once the award has been made. The catalog order will be followed.
The French State has the right of pre-emption of the lots sold, in accordance with the texts in force. The exercise of this right takes place immediately after the word "awarded", the representative of the State replacing the last bidder and having to confirm the pre-emption within 15 days.
The indications given by Lisieux-Enchères on the existence of a restoration, an accident or an incomplete state are given to facilitate its assessment by the purchaser and remain subject to the expert’s assessment. The absence of any indication of restoration, accident or incomplete condition in the catalog or given verbally does not in any way imply that a lot is free from any defects present or past.
In the case of identical auction amounts for the same lot, the oldest order will be used.
‘The voluntary sales operator shall be a member of the Central Register for the Prevention of Unpaid Payments of Auctioneers, to which incidents of payment may be registered. The right of access, rectification and opposition on legitimate grounds shall be exercised by the debtor concerned at Symev 15 rue Freycinet 75016 Paris.’
